3. ¿CÓMO RECOGEMOS SUS DATOS PERSONALES?
Los datos personales de los clientes se recolectan de manera directa mediante formularios físicos o digitales, solicitudes de reserva, correspondencia electrónica o telefónica relacionada con nuestros servicios turísticos, así como a través de terceros autorizados por el titular para proporcionar información relevante para la prestación de servicios.
4. ¿QUÉ DATOS PERSONALES ESTÁN SIENDO TRATADOS?
Se tratan los datos estrictamente necesarios para la prestación de servicios turísticos, incluyendo datos de identificación, contacto, información financiera para facturación y cualquier otro dato relacionado con la gestión de reservas y atención al cliente.
Nota: MASTRAVELSA S.A. no recolecta ni trata datos personales sensibles de los clientes, tales como información biométrica, médica, visitas domiciliarias o pruebas de polígrafo.
5. ¿PARA QUÉ FINALIDADES ESTÁN SIENDO TRATADOS SUS DATOS PERSONALES?
Sus datos personales son tratados exclusivamente para contratar y prestar servicios turísticos de forma eficiente, gestionar reservas, facturación y atención al cliente, cumplir con obligaciones legales, regulatorias o fiscales aplicables, y transferir o comunicar los datos a terceros únicamente cuando sea necesario para cumplir con los servicios contratados.
6. ¿CON QUÉ SUSTENTO LEGAL TRATAMOS SUS DATOS?
El tratamiento de sus datos personales se realiza en cumplimiento de la LOPDP, basándose en los siguientes fundamentos: consentimiento del titular para la prestación de servicios turísticos, ejecución de medidas pre contractuales solicitadas por el titular que en el contexto de la prestación de servicios turísticos, estas medidas comprenden situaciones tales como la solicitud de cotizaciones de paquetes turísticos, el requerimiento de información personalizada sobre vuelos, hoteles o tours, la realización de reservas provisionales, la elaboración de itinerarios y la verificación de disponibilidad o tarifas especiales.
En estos casos, MASTRAVELSA S.A. requiere tratar determinados datos personales como nombres y apellidos, número de documento de identidad, fechas de viaje, destino, datos de contacto u otra información necesaria con la finalidad de atender adecuadamente la solicitud del titular y gestionar una posible relación contractual, ejecución de un contrato o relación comercial, cumplimiento de obligaciones legales aplicables y protección de intereses legítimos relacionados con la prestación de servicios turísticos.
7. ¿A QUÉ DESTINATARIOS PODEMOS COMUNICAR LOS DATOS PERSONALES?
Sus datos personales podrán ser comunicados o transferidos únicamente a terceros relacionados con la prestación de servicios turísticos, tales como proveedores de transporte, alojamiento, actividades turísticas, y autoridades regulatorias cuando sea necesario por ley.
En caso de transferencias internacionales, el titular será informado sobre los datos transferidos, la finalidad de la transferencia, los destinatarios y las medidas de seguridad adoptadas.
8. ¿QUÉ DERECHOS TENGO SOBRE MIS DATOS PERSONALES Y CÓMO PUEDO EJERCERLOS?
Los titulares de los datos tienen derecho a conocer los datos que poseemos sobre usted, solicitar su actualización, corrección, eliminación o revocación del tratamiento, y recibir información sobre transferencias realizadas. 9. ¿CÓMO PROTEGEN MIS DATOS PERSONALES?
MASTRAVELSA S.A. implementa medidas técnicas, administrativas y físicas para proteger sus datos personales frente a pérdida, alteración, divulgación no autorizada o acceso indebido. El responsable del tratamiento, implementa medidas técnicas, administrativas y físicas apropiadas para proteger los datos personales frente a pérdida, alteración, destrucción, divulgación no autorizada o acceso indebido, en cumplimiento de la LODPD.
Previo a la transferencia o acceso a los datos personales por parte de terceros, el responsable verificará que estos ofrezcan garantías suficientes de cumplimiento en materia de protección de datos y seguridad de la información. Asimismo, exigirá la adopción de medidas técnicas y organizativas adecuadas que aseguren la confidencialidad, integridad y disponibilidad de los datos personales, formalizando las obligaciones correspondientes mediante contratos u otros instrumentos jurídicos vinculantes.
10. ¿QUIÉN CONTROLA O SUPERVISA SU CUMPLIMIENTO?
El cumplimiento de esta política es responsabilidad de MASTRAVELSA S.A. y se supervisa a través del área de Protección de Datos Personales, garantizando que todos los colaboradores y terceros vinculados cumplan con los principios y normas establecidos en la LOPDP.
